• Accept customer orders

• Manage menus

• Manage restaurant operations

• Generate QR codes

• Offer contactless ordering

• Manage tables and kitchen workflows

• Use premium add-ons and subscription features

SwadMenu acts solely as a technology platform and is not a restaurant, food delivery company, payment processor, or food service provider.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding agreement to use the Services.

By using SwadMenu, you represent and warrant that you meet these requirements.

3. Restaurant Accounts

Restaurant owners are responsible for:

• Providing accurate information

• Keeping account credentials secure

• Maintaining the confidentiality of passwords

• Updating business information when necessary

• All activities performed using their account

You are responsible for any activity that occurs under your account.

4. Customer Use

Customers may browse restaurant menus and place orders without creating an account.

Customers agree to:

• Provide accurate order information

• Use the platform lawfully

• Not misuse or interfere with the Services

• Follow restaurant policies regarding orders, cancellations, and payments

5. Restaurant Responsibilities

Restaurant owners are solely responsible for:

• Menu content

• Prices

• Taxes

• Availability of items

• Food descriptions

• Images

• Allergen information

• Nutritional information

• Promotional offers

• Food quality

• Food preparation

• Delivery

• Pickup services

• Customer support

• Compliance with applicable laws and regulations

SwadMenu does not verify the accuracy of restaurant-provided information.

6. Orders

SwadMenu provides technology that allows customers to place orders directly with restaurants.

Restaurants are solely responsible for:

• Accepting or rejecting orders

• Preparing food

• Fulfilling orders

• Refunds

• Cancellations

• Delivery or pickup

SwadMenu is not responsible for disputes between customers and restaurants.

7. Subscription Plans

Some features require an active paid subscription.

Subscription plans may include:

• Monthly plans

• Yearly plans

• Lifetime plans (if offered)

Features available depend on the selected subscription plan.

8. Add-ons

SwadMenu may offer optional paid add-ons.

Examples include:

• Custom Domain

• WhatsApp Notifications

• AI Features

• Premium Themes

• Additional Storage

• Additional Restaurant Branches

• Other premium services

Unless otherwise specified:

• Add-ons may be purchased at any time during an active subscription.

• Add-on validity expires on the same date as the user's current subscription.

• Renewing the subscription renews eligible add-ons according to the applicable pricing and plan.

9. Payments

All subscription fees are payable in advance.

Payments are processed through third-party payment providers.

SwadMenu reserves the right to:

• Modify pricing

• Introduce new plans

• Discontinue plans

• Change available features

Price changes will not affect an already active subscription period.

10. Refund Policy

Unless required by applicable law or otherwise stated, subscription fees and add-on purchases are non-refundable after activation.

If a payment is made due to a technical error or duplicate transaction, users should contact our support team for review.

Approved refunds, if any, will be processed using the original payment method where possible.

11. Trial Plans

If SwadMenu offers a free trial:

• Trial features may be limited.

• Trials may expire automatically.

• Paid features may become unavailable after the trial ends unless a subscription is purchased.

12. Intellectual Property

All intellectual property rights relating to SwadMenu, including but not limited to:

• Software

• Source code

• Design

• Logos

• Branding

• Icons

• Graphics

• Website content

• Documentation

remain the exclusive property of SwadMenu or its licensors.

Restaurant owners retain ownership of the menus, images, logos, and other content they upload.

13. Prohibited Uses

You agree not to:

• Violate any applicable laws

• Upload illegal or harmful content

• Attempt unauthorized access to the platform

• Reverse engineer the software

• Introduce viruses or malicious code

• Use automated bots to abuse the Services

• Interfere with platform security

• Copy, resell, or redistribute the Services without permission

• Infringe the intellectual property rights of others

14. Availability of Services

We strive to provide reliable Services but do not guarantee uninterrupted or error-free operation.

The Services may occasionally be unavailable due to:

• Maintenance

• System upgrades

• Technical failures

• Internet issues

• Third-party service interruptions

• Events beyond our reasonable control

15. Third-Party Services

SwadMenu may integrate with third-party services such as:

• WhatsApp providers

SwadMenu is not responsible for the availability, security, or performance of third-party services.

16. Limitation of Liability

• Allergic reactions

• Incorrect menu information

• Pricing errors

• Delivery delays

• Restaurant service quality

• Customer disputes

• Loss of profits

• Loss of business

• Loss of data

• Indirect, incidental, special, or consequential damages

Our total liability arising from your use of the Services shall not exceed the amount you paid to SwadMenu during the twelve (12) months immediately preceding the event giving rise to the claim.

17. Indemnification

You agree to indemnify and hold harmless SwadMenu, its directors, employees, affiliates, and partners from any claims, damages, losses, liabilities, costs, or expenses arising from:

• Your use of the Services

• Your violation of these Terms

• Your violation of applicable laws

• Content uploaded by you

• Claims made by customers or third parties relating to your restaurant or business

18. Suspension and Termination

SwadMenu may suspend or terminate your account if you:

• Violate these Terms

• Engage in fraudulent activities

• Misuse the platform

• Fail to pay applicable fees

• Engage in activities harmful to SwadMenu or other users

Termination does not relieve you of any outstanding payment obligations.

19. Privacy

Your use of SwadMenu is also governed by our Privacy Policy.

By using the Services, you acknowledge that you have read and understood our Privacy Policy.

20. Changes to the Services

We reserve the right to:

• Add features

• Remove features

• Modify Services

• Change subscription plans

• Improve functionality

• Discontinue any part of the platform

We may do so with or without prior notice where permitted by law.

21. Force Majeure

SwadMenu shall not be liable for delays or failure to perform due to events beyond our reasonable control, including but not limited to:
